Was Oklahoma Man the Victim of a Drunk Driver?

When Oklahoma police first reported on an accident that recently occurred on Interstate 35, it was suspected that one of the drivers involved in the two-vehicle accident was impaired. After the initial reports of the crash, police confirmed which driver it was who smelled like alcohol when officers arrived at the scene. The motorcycle rider who was at the wrong place at the wrong time might just be the victim of a drunk driver, along with the passenger in the allegedly impaired driver’s vehicle.

Reports of the accident show that the woman driving the vehicle in this crash was traveling south on the interstate sometime before 3:00 a.m. At the same time, the motorcycle rider was also heading southbound ahead of the other vehicle. The vehicle rammed into the back of the motorcycle.

The impact threw the motorcycle into a guardrail on the right side of the highway. The vehicle also left the roadway to the right and flipped a couple of times before coming to a rest. During the impact, the passenger in the vehicle was thrown out of it. The 27-year-old Wisconsin man suffered severe injuries, and at last report, remained hospitalized in critical condition. The 46-year-old motorcycle rider from Enid is also in critical condition at OU Medical Center.

It is unknown whether police have confirmed that the alleged drunk driver was impaired at the time of the accident. Even so, that does not preclude the motorcycle rider and the woman’s passenger from filing personal injury claims against her. If an Oklahoma court rules that the woman’s negligence caused the injuries to the victims, damages may be awarded. Any monies received could help defray the financial losses from medical bills, lost wages and other damages the men incurred — and may still be incurring — in the aftermath of the crash.
