Traffic on I-35 Diverted for Hours after Fatal Semi Truck Crash
Posted on August 27, 2015
Most Oklahoma residents already know that the traffic on Interstate 35 is seemingly constant — especially during the day. The busy lanes of this highway are not a place that anyone wants to break down and not be able to get their vehicle to a relatively safe spot before coming to a stop. Otherwise, the risk of being involved in a car or semi truck crash rises drastically if a vehicle stops in the lane of travel.
For instance, a stretch of the interstate south of the state capital was shut down for hours due to a fatal accident. Sometime before 4:30 a.m., a vehicle heading north sustained some sort of mechanical failure. The car stopped moving in the lane of travel, and a semi truck crashed into the back of it. Police do not yet know whether the driver had turned on the car’s emergency hazard lights prior to the accident.
The driver of that car suffered fatal injuries in the impact. The driver of the 18-wheeler did not suffer any injuries, but the truck, trailer and its cargo sustained heavy damage. It took troopers with the Oklahoma Highway Patrol a little over five hours to conduct their investigation and clear the scene. It is not yet known whether any charges will be filed against the truck driver.
The family of the deceased driver may exercise its right to file a wrongful death claim against the truck driver and the company for which the driver works. Under the legal theory of respondent superior, an employer may be held liable for the actions of an employee that occurs during the course of employment. A court determination of negligence on the part of the truck driver in this semi truck crash could result in monetary judgments being entered against both that individual and the employer.
