Nursing Homes Under Investigation for Elderly Abuse

Posted on April 26, 2016

A West Virginia man says alleged prolonged abuse and neglect at his grandmother’s nursing home contributed to her death. Jerry Slone, a personal representative of the estate of Wanda Slone, filed a lawsuit in early April in against Seventeenth Street Associates LLC (doing business as Huntington Health and Rehabilitation Center), SavaSeniorCare Administrative Services LLC, SavaSeniorCare Consulting LLC and administrator Annica Stansberry, alleging wrongful death, negligence, reckless misconduct and statutory violations.

According to the lawsuit, Wanda Slone resided at Huntington Health and Rehab for approximately one year (2013-2014), where she required daily living assistance. The suit says Slone suffered from dehydration, colitis, infections, and sepsis during her stay, deteriorating her overall mental and physical well-being. As a result of her injuries, she died of complications of sepsis at the beginning of 2015. Jerry Slone seeks a jury trial and punitive and compensatory damages to be determined at trial.

Legal Standards of Nursing Homes

Certified nursing homes have a legal duty to provide to each resident the best possible care. They are required to help each resident attain and maintain the highest possible physical, mental and psychological well–being. Care, treatment, and therapies must be used to maintain and improve health to the extent possible. If these standards are not met, nursing homes and their professionals can be sued for negligent care or worse, intentional wrongful conduct.

When negligence or wrongful conduct occur, it is important for victims to seek justice as soon as possible to protect their rights.
