An Intoxicated Driver May Not Be Alone in Liablity in a Crash

An individual who is of legal age to drink is not violating any laws by consuming alcohol, until that person decides to get behind the wheel of a vehicle while under the influence of alcohol. At that point, the person has put everyone on the road in jeopardy of being killed or injured in an accident. Nevertheless, the intoxicated driver may not be the only party at fault in the eyes of an Oklahoma civil court.
Bars, restaurants and liquor stores may bear some responsibility for selling alcohol to an impaired driver when it might have been obvious that person was intoxicated. Even private parties can be sued under Oklahoma’s dram shop laws. Of course, the ultimate responsibility belongs to the driver who made the choice to drive under the influence.
If you or a family member suffered serious injuries at the hands of a drunk driver, it may be possible to receive restitution for the damages sustained in the aftermath of the accident. The same is true if you lost a loved one under similar circumstances. An attorney can review your case and determine what damages you may be entitled to, along with identifying all of the parties who may have at least some liability for the incident in addition to the drunk driver.
Based upon the proof submitted, an Oklahoma civil court will determine what parties are to be held responsible for your monetary losses. The intoxicated driver, and others, must first be found negligent before claims for damages will be considered. If more than one party is found responsible for an accident, the court will then determine each negligent party’s percentage of liability. Monetary judgments can help you and your family with your financial recovery, which could relieve at least some of the stresses that accompany such tragedies.
