2 Injured in Trucking Accident

Posted on June 24, 2014

One person was injured in a trucking accident that occurred in Oklahoma on June 17. The incident happened on State Highway 3 nearby Broken Bow. A 36-year-old woman driving a Buick LeSabre was rear-ended by a 51-year-old man driving a 2013 Peterbuilt log tractor-trailer. According to investigators, the truck driver failed to stop for a flag man warning motorists of a construction zone. That’s when he struck the woman’s vehicle.

Police say the accident victim was not wearing a seat belt when the collision occurred. She was airlifted to Texarkana’s CHRISTUS St. Michael hospital to receive medical treatment for her injuries. Local reports were uncertain of the severity of her injuries after the crash. Her son was also an occupant in the vehicle when the accident happened. He was brought to Idabel’s McCurtain Memorial Hospital to receive medical treatment for internal injuries. The truck driver was uninjured in the crash.

The accident victims in this crash may have grounds for filing a personal injury claim against the driver. In most civil law suits, the driver who initiates the rear-end collision is typically the one considered to ultimately be at-fault. Trucking accidents on state highways often occur due to some degree of driver negligence. These drivers are often fatigued, violating traffic signals, speeding, driving recklessly, distracted or intoxicated when they cause an accident.

In order to recover restitution in cases like these, lawyers are often tasked with proving that the other driver’s negligence caused the damages resulting from the crash. The victims may be entitled to receive compensation that can help account for medical costs, repair expenses for vehicles and any loss of income that results from the accident. In an effort to prove a driver or his employer was negligent, lawyers might choose to consult a reconstruction specialist or forensic technician.
