1 Dead, 3 Injured In Oklahoma Wreck
Posted on July 8, 2014
A teenager died and three others were severely injured in a single-vehicle accident that happened on July 3 around 1:15 a.m. in Mayes County. Oklahoma Highway Patrol reported that the 16-year-old driver was intoxicated at the time of the fatal crash.
The accident occurred on a back road a few miles outside of Spavinaw according to the Oklahoma Highway Patrol. The driver of the 2007 Nissan Maxima reportedly lost control of the car while driving through a curve in the road. The westbound car then veered off of the road’s left side, struck several trees after sliding back across the street and overturned on its side.
According to the news source, the decedent suffered ‘massive” injuries and was declared dead at the scene. A 19-year-old passenger was in critical condition after suffering a serious injury to his head. That passenger and the driver were both airlifted to a nearby hospital. The other passenger was transported by ambulance to a hospital in Tulsa with head and internal injuries, troopers said.
Family members of someone killed in an auto accident might consider filing a wrongful death suit against the driver they believe to be responsible for the crash. In order win that legal battle, however, an attorney representing that family would need to convince a jury that the defendant’s negligent actions led to the crash. That lawyer would likely review police reports and witness statements for evidence of the defendant’s fault. Also, any criminal charges faced by a defendant could be used to substantiate the allegation of negligence in a civil suit. Plaintiffs of wrongful death suits can be awarded compensation for harm caused by the accident, which can include medical and burial costs, as well as psychological pain and suffering.
